Extrajudicial Mechanism for Settlement of Debts to Banks, Public & Insurance Funds

 

Law 4738/2020 introduced a modern legislative framework for the comprehensive settlement of debts to banks, the State and Social Security Institutions. The Extrajudicial Mechanism provides the possibility of settling debts through a special procedure, which requires the assistance of a specialized legal advisor, in order to ensure its correct and effective implementation. Benefits of the Settlement: Possibility of writing off part of the principal debt, as well as interest, fines and surcharges. Suspension of enforcement measures, including seizures and auctions, subject to compliance with the settlement. Long-term settlement: Up to 240 installments for debts to the State and Social Security Institutions. Up to 420 installments for debts to Banks and Claims Managers (Funds). Eligibility Requirements: The total debts owed to creditors must exceed 10,000 euros. The debtor must not have already been subject to previous debt settlement procedures (e.g. N. Katseli), unless his application was rejected or he withdrew from it. The successful completion of the procedure requires the technical knowledge and negotiating experience of a specialized lawyer, in order to ensure the best possible settlement and protection of the debtor's rights. Full Legal Support in the Extrajudicial Debt Settlement Mechanism We undertake the full and integrated handling of the electronic platform of the Extrajudicial Mechanism, from the creation of the application to the completion of the procedure, ensuring legal integrity and the correct application of the legislation at every stage.

Golden Visa Greece – Residency by Investment

 

The Golden Visa Greece program offers third-country investors the opportunity to obtain an immediate five-year residence permit, allowing them to travel freely within the 26 Schengen Area countries. This program provides access to the European market, opportunities for business activities, and the potential to apply for Greek citizenship. The Schengen Agreement, signed in 1985, established a free movement zone among its member states by eliminating internal border controls, enabling Golden Visa holders to travel across Europe without restrictions. Today, the Schengen Zone covers over 400 million residents, enhancing mobility, trade, and investment opportunities. Greece’s residency-by-investment program is recognized as one of the most favorable internationally, offering unrestricted travel, the right to register a business in Greece, and the possibility to apply for Greek citizenship under specific conditions. Additionally, it applies to three generations, covering the main investor, their spouse, children up to the age of 21, and the parents of both spouses. The approval process is particularly fast, as a temporary residence permit is issued immediately upon application submission, with no requirement for physical presence in Greece to maintain the permit. The program also offers significant investment flexibility, as the sale of the property to another third-country investor automatically transfers the residency rights to the new owner. Furthermore, investors can rent out their property to generate financial returns, and they may transfer ownership to their children after they turn 24 years old without losing the permanent residency status. The Golden Visa can be the first step toward acquiring Greek citizenship. Children must attend a Greek school for six consecutive years before reaching adulthood to apply for citizenship upon turning 18. Adults must reside in Greece for seven consecutive years, spending at least 183 days per year, and successfully pass the official Greek language proficiency exam. The Golden Visa Greece is an ideal choice for investors, offering security, economic and tax benefits, access to Europe, and a clear pathway to Greek citizenship.

Ioannis Konstantinidis was born in Thessaloniki in 1988 and is a Law graduate and Political Scientist, holding a Master’s degree in Economics (MSc in Health Economics, Policy, and Law) from Erasmus University of Rotterdam. Additionally, he holds a Diploma in Corporate Social Responsibility (Corporate Sustainability: Understanding and Seizing the Strategic Opportunity) from Università Bocconi. His professional career began in 2011 at the European Parliament, where he served as a political staff member for the Greek-Cypriot Minister of Foreign Affairs and Member of the European Parliament, Ioannis Kasoulides. Since 2016, he has held executive positions in multinational companies in Greece, Cyprus, and the Netherlands, gaining significant expertise in business management and strategic corporate development. Mr. Konstantinidis is the founder and driving force behind the firm, which provides comprehensive corporate services, integrating legal solutions with financial and strategic planning, tailored to meet the diverse needs of businesses. He specializes in commercial law, debt restructuring, and corporate operations, offering customized legal and business solutions that align with the unique demands of each client.
